Fitness Australia to provide consumer contract template to fitness industry
To support the introduction of the new Australian Consumer Law, Fitness Australia will provide the industry with a consumer contract template, aligned to the new consumer contract provisions that came into effect on 1st July 2010.
"Fitness Australia is in support of the new Australian Consumer Law and national consumer policy framework," says Craig Knox, General Manager of Industry Development at Fitness Australia.
"The development of the new Australian Consumer Law is an important step in reducing regulatory complexity across the nation."
"Fitness Australia will provide a consumer contract template for use by Registered Businesses to help them adjust to and comply with the new Australian Consumer Law."
"The new law also provides an opportunity for Fitness Australia to align the state based code of practice to the new provisions and move towards a nationally consistent approach to consumer contracts for the Australian fitness industry," said Knox.
Craig Knox went on to say that the new national law sets out specific provisions in relation to unfair contract terms and these will be adhered to within the content of the contract template.
In light of the new national provisions and industry consultation, Fitness Australia will also work with all state and territory based fair trading offices on the proposed fitness industry contract. The fitness industry membership contract template will be available in August 2010.

• The Trade Practices Amendment (Australian Consumer Law) Act (No. 1) 2010, which came into effect on July 1st, lists provisions for unfair contract terms on page 6, 7 and 8.
To enhance the fitness industry's reputation, contracts must be fair and transparent for the consumer. Fitness Australia will make available a consumer membership contract template for Registered Businesses.
